These Terms of Service ("Terms") govern your access to and use of OnAssist AI's website, dashboard, and AI chat/voice widget (together, the "Service"), operated by ONASSIST ("OnAssist," "we," "us"). By creating an account or using the Service, you agree to these Terms.
By accessing or using the Service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), have authority to bind your business if applicable, and agree to these Terms and our Privacy Policy.
OnAssist provides an AI-powered chat and voice agent that businesses can configure and embed on their websites to answer visitor questions, capture leads, and support customers.
You must provide accurate, current information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account.
OnAssist offers a free plan and paid subscription plans (Starter, Growth, Pro) as described on our Pricing page. New accounts may start with a 14-day free trial of full product features. Unless you upgrade to a paid plan or cancel before the trial ends, your account will automatically move to the Free plan — no credit card is required for the trial, and you will not be charged automatically at the end of it. Paid subscriptions are billed in advance on a monthly or annual basis and automatically renew until cancelled.
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period; see our Refund Policy for details on refunds.
You agree not to use the Service to: violate any law; transmit harmful, deceptive, or infringing content; attempt to reverse-engineer or disrupt the Service; use another party's account without permission; or configure your AI agent to impersonate a real person, make fraudulent representations, or collect sensitive personal information from visitors without appropriate disclosure and consent.
You retain ownership of the documents, FAQs, branding, and other materials you upload to train your AI agent ("Your Content"). You grant OnAssist a limited license to use Your Content solely to provide and improve the Service on your behalf. You are responsible for ensuring you have the rights to upload Your Content and that it complies with applicable law.
Responses generated by your AI agent are produced automatically and may occasionally be inaccurate, incomplete, or inappropriate. OnAssist does not guarantee the accuracy of AI-generated responses. You are responsible for reviewing your agent's configuration and monitoring conversations, and for any decisions made in reliance on AI-generated output.
The Service may integrate with third-party platforms (such as CRMs, webhooks, or e-commerce platforms) that you choose to connect. Your use of those integrations is subject to the third party's own terms and privacy practices.
OnAssist and its licensors own all rights, title, and interest in and to the Service, including our software, branding, and underlying technology. These Terms do not grant you any rights to our trademarks or branding except as needed to use the Service as intended.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, OnAssist will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold OnAssist harmless from any claims, damages, or expenses arising from your use of the Service, Your Content, or your violation of these Terms.
We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use poses a risk to OnAssist or other users. You may stop using the Service and cancel your account at any time.
These Terms are governed by the laws of Texas, USA, without regard to its conflict-of-law principles. Any disputes will be resolved in the courts located in Texas, USA, unless otherwise required by applicable law.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
